Plaintiff was an HVAC repair man who fell through a covered opening in the attic 10 feet to the first floor below.

Plaintiff (48 at the time) was an HVAC repair man who fell through a covered opening in the attic 10 feet to the first floor below. Plaintiff's alleged negligence as to the premises owner. Plaintiff suffered a comminuted fracture of the right distal tibia resulting in ultimate fusion of the ankle, and developed bilateral massive pulmonary embolis. Plaintiff's case was tried before a Contra Costa jury in February 2006, which returned a verdict in plaintiff's favor for 1 million dollars.
