$350,000 Police Misconduct, Unlawful Search, 2000

Unlawful search against multiple police agencies.

Margaret Rohrbach and her daughter rented an apartment next to the Hells Angels Club House in Oakland. On March 27, 1998, several police agencies, including the State Department of Narcotics Enforcement, Fremont Police Department, and the Monterey County District Attorney's Office, raided the Hells Angels Club House and searched Ms. Rohrbach's apartment. Ms. Rohrbach and her daughter were unlawfully detained by the police for several hours. No items of contraband were found and Ms. Rohrbach and her daughter filed suit for violation of Civil Rights. The case was settled for $350,000.

"Other than being former tenants, Rohrbach and her daughter have no connection to the Hells Angels, said their attorney, Andrew Schwartz of Walnut Creek, who announced the settlement yesterday. 'This vindicates my client,' Schwartz said. 'The agents involved in this illegal search were very heavy-handed with Mrs. Rohrbach and her daughter. They terrorized both of them without any justification whatsoever.' Schwartz said some state agents had expressed doubts of the legality of the search of Rohrbach's home."
