Equipment malfunction leaves electrician with crushed hand after routine maintenance procedure backfires.
This case involved an industrial accident. Plaintiff Cesar Ebalo, an electrician, was operating a manlift in conjunction with a routine assignment to change a light bulb. When he attempted to lower the lift, it malfunctioned, jerking upward and causing a crush injury to his hand.
CMS&C discovered that the Defendant, Prime Equipment, had allegedly replaced a malfunctioning up/down control lever 90 days earlier during a service call. However, the Plaintiff claimed that the Defendant never installed a new control lever or properly repaired the lift.
CMS&C gathered experts, including a forensic economist and vocational rehabilitation specialist, to assess the Plaintiff's damages. Although, the Defendant denied the Plaintiff's claim, CMS&C was successful in settling the suit for $875,000.
