Most California drivers understand the importance of watching for pedestrians and complying with motor vehicle laws. Unfortunately, not all drivers are vigilant. When drivers are negligent and car accidents occur, serious injuries can occur and lives can be lost.
Tragedy struck in San Diego recently, as a woman crossing a street was hit by a car. The woman died at the scene of the accident. The driver of the car has not been charged with a crime at his time, although criminal charges are possible. The investigation is ongoing, and the motorist and any witnesses will be questioned in order for investigators to gain an understanding of the details regarding the accident.
Surviving families of fatal car crash victims typically find themselves struggling to make sense of a sudden and senseless loss of a loved one. Moreover, they often find that they must also cope with medical bills, funeral costs and other end of life expenses. Fortunately, there are legal remedies available in many instances.
In situations in which wrongful death occurs, successful civil litigation can help provide reimbursement for the financial damages sustained. If the person who hit the woman is found to be at fault in a civil suit, a monetary award for the damages sustained may be ordered by the appropriate civil court. To prevail, as with other fatal California car accidents, the family will need to document to the satisfaction of the court that the negligence of another party caused or contributed to the fatal crash. In those car accidents where liability is established in court, claims for financial damages said to have resulted will be adjudicated.
