Attorney Schwartz’s clients sued the school district and physical education teacher after their son drowned in the high school swim class. Video surveillance showed that the student drowned during class and was not discovered until approximately one-and-one-half hours later when the next class returned after lunch period. Our team maintained that the school and teacher were liable for failing to supervise the class properly, and they lacked necessary policies and procedures to provide a safe environment for students, including lacking a lifeguard who could assist the teacher.
The settlement was reached before the trial.
